Commission Rate:
I hereby agree to pay you a commission for your services at the following rates:
On a Sale: 5% commission up to $1.5MTT ($250,000US) and
3% commission on any amount above $1.5MTT ($250,000US)
Period of Agreement:
This agreement is for a period of 6 months and is extended for a further 6 months unless revoked by me in writing.
Conditions:
After contracts are exchanged the deposit is to be held by yourselves, Almandoz Real Estate Limited (the estate agent) in escrow pending the title being found to be in good order. If title is found to be in good order, then the estate agent shall be entitled to deduct its commission and any other agreed costs, remitting the balance to the Owner.
If within 180 days after the termination of this agreement a sale is made to anyone to whom the Estate Agent has shown the property, then commission is payable to the Estate Agent providing the Estate Agent has advised the Owner of the name of the person before such termination.
If the Owner does not complete the sale although the title is good or if the Owner and the Purchaser agree to rescind the contract the commission is still payable.
The commission is payable on the sale price including any furniture, fittings, appliances etc. which are included in the price.
Service of Estate Agent:
1.In consideration of the listing the Estate Agent agrees at its sole discretion to make diligent efforts to procure a buyer, may advertise the property and keep the Owner informed as to the progress in the matter.
2.The Estate Agent will be entitled to access to the property for the purpose of showing it to interested parties.
3.The Owner warrants (1)that he has the authority to sell and to enter into a contract for the sale and this agreement and (2) that he has good marketable title to the said property.
4. In this agreement the singular shall include the plural and masculine terms shall include the feminine.
